Keller Rohrback is investigating Chrysler LLC and Dwight Asset Management Co., for potential breach of fiduciary duty. The investigation focuses on the Chrysler Stable Value Fund B and other Chrysler Stable Value Funds (collectively, the “Funds”) offered to participants and beneficiaries of the Chrysler LLC 401(k) Plan (the “Plan”).
Keller Rohrback’s investigation involves concerns that the Plan’s sponsor, Chrysler LLC, and the Funds’ investment manager, Dwight Asset Management Co., may have breached their fiduciary duties of loyalty and prudence to the Plan’s participants and beneficiaries who invested their account in the Funds. A breach may have occurred if the investment manager or other fiduciaries failed to manage the assets of the Plan prudently and loyally by investing the assets of the Funds in high-risk or highly leveraged bonds or in insurance-company contracts tied to mortgage-backed securities when they were not prudent investments for a conservative stable-value fund. Additionally, a breach may have occurred if the fiduciaries failed to properly set risk budgets to plan for market volatility and participant withdrawals or failed to properly inform Plan participants and beneficiaries of Chrysler’s financial situation.
Additionally, we are investigating potential breaches of fiduciary duty with respect to losses in Fixed Income Bond Funds that are offered as investment options in retirement plans across the country.
